Can a Creditor File a Legal Case for Unpaid Debt in Dubai?

Can a Creditor File a Legal Case for Unpaid Debt in Dubai? Yes, if the debt is due, supported by evidence, and pursued through the correct procedure.

A creditor has the right to file a legal case before Dubai courts to recover unpaid debts. For the case to be accepted, the financial claims must be due for payment, and there must be solid legal evidence. The correct legal route must also be followed.

The mechanisms for debt collection and protecting creditors’ rights before these courts are regulated by Federal Decree-Law No. 42 of 2022 on the Civil Procedure Law.

Summary

A creditor must choose the route that matches the debt and available evidence. Written, due, determined claims may support an order for payment, while qualifying returned checks follow direct enforcement rules.

Notice, registration fees, service, and execution each have separate requirements. After obtaining an enforceable instrument, asset seizure, travel restrictions, and payment arrangements remain subject to statutory conditions and judicial decisions.

Going to court becomes an available option for the creditor when the debtor refuses to pay after the deadline set in the contract or commercial transaction has passed. Article 143 of Federal Decree-Law No. 42 of 2022 addresses a right established in writing, due, and of a determined amount. It allows the creditor to begin the relevant legal claim procedures.

The law also requires sending a formal payment demand before taking steps to claim by way of an order for payment. This creates a binding instrument.

For the underlying contractual claim, read about breach of contract under UAE law.

The appropriate filing route also depends on the debt instrument and whether the debtor has assets available for enforcement. For further context, see the Leaders Advocates publication on UAE debt collection laws and debt recovery procedures on Legal 500.

How Can a Creditor File a Debt Recovery Claim?

A debt collection case starts with a statement of claim or an electronic order for payment application through Dubai Courts. Articles 44 and 143 of Federal Decree-Law No. 42 of 2022 govern these routes. These procedures first require formal payment notice to the debtor, with at least 5 days to pay.

Article 144 — Payment Notice

Article 144 of Federal Decree-Law No. 42 of 2022 sets this period.

The claim or payment order request is then submitted through Dubai Courts’ digital system. Fees are payable within 3 business days from the day after the court’s payment notice (Article 47 of the same Law). Finally, the debtor is officially notified of the order for payment or the hearing date, according to the notification rules in Article 9 and Article 146 of the same Decree-Law.

What Documents Are Needed to Prove an Unpaid Debt?

The court requires written and documentary evidence proving the debt is valid and due, based on Article 143 of Federal Decree-Law No. 42 of 2022. The list of basic documents includes:

Evidence Document and Legal Position
Contracts and Orders The concluded contracts and approved purchase orders between the parties.
Invoices and Delivery Commercial invoices and documents showing delivery of goods or completion of services.
Debt Acknowledgment Electronic correspondence and account statements containing an acknowledgment of the debt.
Returned Checks Returned checks with the bank’s refusal-to-pay certificate. A check returned for no or insufficient funds is an executive instrument, enforceable directly before the execution judge rather than through a payment order. Article 143/2 of Federal Decree-Law No. 42 of 2022 and Article 667 of Federal Decree-Law No. 50 of 2022 govern this route.

Before enforcement, distinguish the types of UAE court judgments.

For cases involving a returned cheque, the Leaders Advocates article on how to collect a bounced cheque from a bank on Lexology explains the relevance of the bank’s written notation and the direct enforcement procedure.

What Happens After a Creditor Obtains a Judgment?

After a final judgment for the creditor or an enforceable payment order, an execution file is opened before the execution judge. Articles 207 and 212 of Federal Decree-Law No. 42 of 2022 govern this stage. The court then begins compulsory enforcement measures against the debtor.

These measures include seizure of funds, bank accounts, real estate, and cars under the same Decree-Law’s seizure rules. Travel bans are governed by Articles 324 to 326. Under Article 319, the execution judge may also order the imprisonment of a debtor who refuses to pay, unless the debtor proves inability to pay.

Can a Creditor Recover a Debt If the Debtor Has No Available Assets?

If no visible assets are found for the debtor that are enough to pay the debt, the creditor’s rights remain in law and do not lapse. In this case, the execution judge may continue to search for the debtor’s assets through government and banking authorities. Article 320 of Federal Decree-Law No. 42 of 2022 allows a grace period of up to 6 consecutive months.

Alternatively, the judge may allow suitable installments over up to 3 years. Guarantees or precautionary measures may be required if the debtor may flee the country. This does not affect the creditor’s right to keep tracking assets.
