Can WhatsApp Messages Prove a Debt in the UAE? Yes, messages can provide electronic evidence, but they do not automatically establish the debt. The court assesses authenticity, sender identity, context, and what the conversation proves.
Federal Decree-Law No. 35 of 2022 on Evidence in Civil and Commercial Transactions governs the evidentiary framework. Accepting messages as evidence does not automatically mean judgment for the creditor.

Can WhatsApp Messages Prove a Debt in the UAE Under the Evidence Law?
Article 54, items 5 and 6, recognizes relevant electronic correspondence. Article 55 applies documentary-evidence rules to electronic evidence.
Article 59 generally gives such correspondence the evidentiary value of an informal document, subject to the applicable conditions.
Article 57 identifies when informal electronic evidence is valid against the parties unless the contrary is proved. Article 58 places the burden of proving invalidity on a challenger to evidence covered by Articles 56 and 57.
Electronic Evidence Under Federal Decree-Law No. 35 of 2022
These rules distinguish admissibility and evidentiary weight from proof that a particular person owes money. A creditor must still establish the obligation.
For related court treatment of messages, see the article on text messages as evidence in UAE proceedings.
What the Conversation and Supporting Records Should Establish
The evidence should address:
- The sender’s identity and the link between the account and alleged debtor.
- Whether the transfer was a loan or debt, rather than a gift, investment, or service payment.
- The amount claimed and repayment terms.
- Whether payment is due and the outstanding balance.
- Any repayment, settlement, or other discharge of the obligation.
A message saying “Thank you for the money” may establish receipt without establishing a loan. The full conversation and related records must show why repayment is owed.
A hacking allegation or dispute over number ownership must be assessed against the evidence. A prior police report may assist, but it is not an automatic statutory requirement.
The court may order technical verification where appropriate. Even genuine messages must establish the debt, rather than merely contact between the parties.
A debt claim is generally stronger when messages are supported by bank transfers, agreements, and a clear calculation of the outstanding amount. The Leaders Advocates publication on UAE debt collection laws and supporting evidence on Legal 500 discusses how documentation affects the recovery procedure.
Civil Transactions Exceeding AED 50,000
Article 66(1) generally requires writing for civil transactions exceeding AED 50,000, subject to statutory exceptions. WhatsApp messages may satisfy written electronic-evidence requirements if authenticity and content establish the obligation.
A separate signed loan agreement is not necessarily required if the available evidence satisfies the applicable rules. The absence of a paper contract does not automatically prevent a claim.
Under Article 51, writing attributable to the other party may constitute a principle of documentary evidence if it makes the alleged transaction likely.
Other evidence may then support it under Article 68. A vague acknowledgment does not automatically satisfy that test.
Bank transfers and electronic payment records may assist, subject to Article 63. They may show payment without proving whether repayment was agreed.
Commercial Transactions and Proof
For commercial transactions, Article 91 of Federal Decree-Law No. 50 of 2022 permits proof by all means.

Preserving and Submitting WhatsApp Evidence
Article 60 permits electronic evidence in its original format or through another electronic means. Preserve the full conversation, phone, and reliable electronic backups where possible.
These records can help establish context and authenticity if verification is requested. Under Article 63, matching extracts can have the same evidentiary value as the electronic record.
Deleting the original chat may make authentication harder. It does not automatically mean the claim fails or that printed screenshots can never be considered.
Under Article 61, unjustified refusal to provide court-requested verification material may affect reliance on the evidence. Depending on the circumstances, evidence may instead be treated as valid against the refusing party.
The article on preserving digital evidence during a dispute explains common risks associated with deletion and incomplete screenshots.
Challenges to Copies and the Procedural Fine
Article 48(3) of Federal Decree-Law No. 42 of 2022 on Civil Procedure addresses unjustified challenges to copies later established as genuine.
A fine of AED 1,000 to AED 10,000 may apply where the challenge causes delay or unnecessary expense. Merely questioning a copy does not automatically trigger the fine.
Privacy and Lawful Use of Conversations
Submitting a conversation in which someone participated differs from unlawfully obtaining, recording, or disclosing private communications. Lawfulness depends on the circumstances and applicable exceptions.
Article 431 of Federal Decree-Law No. 31 of 2021 on Crimes and Penalties protects private communications against specified violations.
Article 44 of Federal Decree-Law No. 34 of 2021 on Countering Rumors and Cybercrimes provides related digital privacy protections.
Evidence preservation should therefore be assessed alongside lawful acquisition and disclosure. Having a potentially useful message does not resolve every privacy question.
